My reply to Vincent and Walters’ email which told me I cannot send emails to owners without the express consent of the president and the administration, and that the website also lacks any legal basis.

Let me be very clear about my work and behaviour in this community.

1. I share my opinions by email with my friends in the community but not with people with whom I do not have a friendly relationship. That is a personal matter and I do not need anyone`s permission to write to my many friends.

2. I have not made any negative comments about you in any email. I have simply observed that you are doing work which we actually pay the administrator to do.

3. The web sites which I maintained for the information of owners was requested and authorised by unanimous vote of the community in a General Meeting on 22 April 2015 (Item 5). The areas which contained names of owners (such as minutes of meetings) were password protected in accordance with GDPR regulations.

4. The current administrator made false, and in my opinion defamatory, comments about me in an email copied to the President. Among her claims were: "In all the conclusions drawn after your actions, the same conclusion is reached: you don't care about the community, you only pursue personal interests".

These are personal insults, contradicted by all the community documents from my time as president, and I do not believe the community should have and pay an administrator who makes such comments. She also claimed that the web site was illegal.

As requested by the community in 2015, I have for almost 11 years maintained a web site so that all owners can see all official documents in their own language. I also published monthly newsletters in all languages to keep owners informed as to the actions I was taking to solve the problems that the community had and give owners an opportunity to comment. In summary:

I was elected president of the community at the EGM on 22 April 2015.

The summary of my work as president was as follows:
As president, I am happy with the progress we have made in the last 15 months since I was elected. We now have clean, safe tap water having cleaned the water tanks that had not been cleaned for 7 years. The swimming pool water is now automatically maintained at legal standards. Leaks in the swimming pools have been repaired. We have substantially reduced bad debts and have 100.000€ in the bank. Electricity contracts have been re-negotiated to give considerable savings and we have appointed Lumina to make further reductions in cost. We have negotiated a 43,000€ refund from CajaSur for the repair of defects in the work they supervised and have discovered further work that needs to be reclaimed. We have reports from two architects on the causes of the cracks in terraces and walls. We have formulated a plan for the garden based on reports from a professional gardener. We have a community web site which provides up to date information about the community and items of interest for owners. We have introduced an on-line voting system to allow non-resident owners to play a full part in meetings. Optical fibre has been installed throughout the community at no charge. And we have reduced the community fee to around 200€ per month which includes our contributions to El Soto Club and the EUC Vicario who maintain the streets.
We now need to carry out the works necessary to repair the defects left by the CajaSur supervised work, implement the repairs necessary as a result of the architects' reports and implement the decisions taken at the AGM regarding the garden. Project management is not something that I am particularly good at and it really needs someone who can ensure that the administrator properly manages and controls the work to be done, in line with the wishes of the community as expressed in general meetings. In particular, the decisions of the August AGM must be translated into action.

In May 2016, I went to negotiate with CajaSur in Córdoba. The result was that CajaSur paid us €42,609 in compensation for the repair of defects in the work they supervised.

Clearly I DO care about the community and at no time have I pursued my personal interests nor received any payment, commission or other economic or material benefit. Quite the contrary.

The work of maintaining the website that the community had requested was very considerable and the costs of hosting the website on a professional web server were substantial and totally paid by me. The community paid nothing.

As a result of your email and the administrator’s insults I am no longer prepared to continue with the work and the costs and I have deleted the information from the server. If you or the administrator wish to make all the information available to owners (many of whom are not resident here and want to see the information from their homes and not spend holiday time visiting the administration offices) I trust you will do so. The information was mainly all minutes of meetings since 2007, in all languages, and all reports from architects and other experts regarding the problems we faced. The information is in the community minute book and in the boxes of information that I gave to the president from the previous administrator. I have spent 11 years working for the community's benefit, at considerable personal cost. After the insults received and the attitudes shown at the 2026 AGM I am not prepared to continue under the current administration and board.

I believe the approach in the best interests of the community would be to call an EGM at which all of the above comments are presented, and voting held to appoint new administrator and board.
